Terms of Service

1. Purpose

These terms of service (“Terms”) govern access to and use of the ThumbnailMaker service (the “Service”), an application that generates thumbnails for YouTube videos using artificial intelligence models.

2. Service publisher

The Service is published by Aymane Senhaji, an individual operating as a sole trader, based in Rabat, Morocco. Contact: contact@thumbnailmaker.so.

3. Acceptance of terms

Creating an account on ThumbnailMaker constitutes full acceptance of these Terms. If you do not accept these Terms, you must not use the Service.

4. Description of the service

ThumbnailMaker generates YouTube thumbnail images from a text description and a preset style. Generation relies on third-party artificial intelligence models (including Google's Gemini API). Each account has a number of generation credits, some of which are granted on sign-up. Each generation consumes a number of credits that depends on the options selected (resolution, style, style preset). Additional credits can be obtained through a paid subscription; see the pricing page for current plans and the Refund Policy for billing terms.

5. User account

Using the Service requires creating an account associated with a valid email address. The user is responsible for the confidentiality of their credentials and for all activity carried out from their account. A user may only create one personal account for their own use.

6. User-submitted content

The user retains ownership of the text they submit to the Service (“User Content”). By submitting User Content, the user:

  • warrants that they hold all necessary rights to that content, including the right to the image of any people depicted (their own, or that of third parties who have consented);
  • grants ThumbnailMaker the technical right necessary to transmit that content to the artificial intelligence model providers used by the Service, solely for the purpose of generating the requested thumbnail.

The Service generates thumbnails from text descriptions only. It does not accept photographs of people, and cannot be used to place one person's likeness onto another image. You may not use it to generate a recognizable likeness of any real person, whether a public figure or a private individual, whether named in a description or implied by it. This applies regardless of your intent, including for parody, commentary or illustration, and breach may result in immediate termination of your account without refund.

This is enforced, not only stated: a description naming or identifying a real person is refused automatically, before any image is generated and before any credit is used. The same check applies when you ask for a correction to an existing thumbnail.

It is likewise forbidden to use the Service to generate misleading, defamatory content, or content that damages any person's reputation. Breach of this section may result in immediate termination of your account without refund.

7. Generated thumbnails

Subject to compliance with these Terms and the terms of use of the relevant third-party AI models, the user has the right to use the thumbnails they generate via the Service, including for publication on video platforms.

8. Acceptable use

It is forbidden to use the Service to:

  • generate illegal, defamatory, hateful, pornographic, or violent content;
  • impersonate a third party or create misleading content intended to deceive the public;
  • infringe on intellectual property rights or another person's right to their image;
  • attempt to circumvent the credit system or access the Service through unauthorized automated means.

ThumbnailMaker reserves the right to suspend or terminate any account that breaches these rules.

9. Limitation of liability

The Service is provided “as is.” ThumbnailMaker does not guarantee that generated thumbnails will be free of errors or perfectly match the request, as generation relies on artificial intelligence models whose behavior is not entirely predictable. ThumbnailMaker cannot be held liable for the user's use of generated thumbnails.

10. Termination

The user may delete their account at any time from their account settings. ThumbnailMaker may suspend or terminate an account in the event of a violation of these Terms.

11. Changes to these terms

These Terms may be changed at any time. Users will be notified of any material change. Continued use of the Service after a change constitutes acceptance of the new terms.

12. Governing law

These Terms are governed by the laws of Morocco, without regard to its conflict-of-law principles.
